(“ElegantCMS” “Elegant” or “we”) is committed to protecting the privacy of our users (“users” or “you”).   This Privacy Policy covers how we collect, use, retain, disclose, and transfer data (“Data”or “data”) on www.elegantcms.net or any subdomains (the “Website” or “Site”) and/or our cloud based content management services (“Services” or “Application Services”). This Policy applies to data collected online and offline. For the purposes of this Policy, Elegant Labs is the Controller.

By accessing this Site and/or the Services, you accept and hereby expressly and unambiguously consent to our collection, use, retention, processing, disclosure and transfer, including international transfer (together “processing”), of your data in accordance with the terms of this Privacy Policy. Your use of the Site or Services signifies your express and unambiguous consent to this Privacy Policy. If you do not agree to this Privacy Policy, you must immediately stop using the Site and/ or Services.

Changes to this Privacy Policy

This Privacy Policy may change from time to time, so please check back periodically to check the most recent modification date to ensure that you are aware of any changes in our processing of your data. If we make any material changes we will notify you by means of a notice on this Site prior to the change becoming effective. Your continued use of the Site or Services after any changes signifies your express and unambiguous consent to any such changes. EU-US Privacy Shield and Swiss- US Privacy Shield - Certification in Progress

Elegant Labs is in the process of self-certifying with the EU-U.S. Privacy Shield Framework and Swiss-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union and Switzerland to the United States.  Elegant Labs is self-certifying with the Department of Commerce that it adheres to the Privacy Shield Principles.  If there is any conflict between the terms in this privacy policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern.  To learn more about the Privacy Shield program, and to view our certification, please visit https://www.privacyshield.gov/

In compliance with the Privacy Shield Principles, Elegant Labs commits to resolve complaints about our collection or use of your personal information.  EU and Swiss individuals with inquiries or complaints regarding our Privacy Shield policy should first contact Elegant Labs at:

Elegant Labs has further committed to refer unresolved Privacy Shield complaints to ICDR/AAA, an alternative dispute resolution provider located in the [United States]. If you do not receive timely acknowledgment of your complaint from us, or if we have not addressed your complaint to your satisfaction, please contact or visit http://go.adr.org/privacyshield.html for more information or to file a complaint.  The services of ICDR/AAA are provided at no cost to you.

Under certain conditions, more fully described on the Privacy Shield website, you may be entitled to invoke binding arbitration when other dispute resolution procedures have been exhausted.

With respect to personal data received or transferred pursuant to the Privacy Shield Framework, Elegant is subject to the regulatory enforcement powers of the U.S. Federal Trade Commission

Information Collection and Use

1. Personally Identifiable Information

This is information you voluntarily submit to us. It includes any information relating to an identified or identifiable natural person, such as name, email address, and phone number and which is not otherwise publicly available. Personal Information may include other types of information depending on the definition that applies in your physical location. Only the legal definition of Personal Information that applies in your location will apply to you under this Privacy Policy.

We may collect Personal Information when:

  • You provide it to us by signing up for an account and or paying for the Service
  • You provide it to us by filling out a form to request content, such as an ebook or newsletter
  • You provide it to us by filling out a form or starting a conversation to request additional information about our Services
  • You provide it to us by applying for a job on our website
  • You provide it to us by contacting us via email or telephone
  • A third party provides it to us for business purposes after your explicit consent

Except as may be authorized by you, we use your Personal Information in a way that is compatible with and relevant to the purpose for which it was collected and in accordance with the applicable lawful basis for such processing.

2. Non-personally Identifiable Information

As you navigate the Elegant Labs Website, we may also collect information through the use of commonly used information-gathering tools, such as Web beacons (“Web Site Navigational Information”). Web Site Navigational Information includes standard information from your Web browser (such as browser type and browser language), your Internet Protocol (“IP”) address, and the actions you take on the Elegant Labs Websites (such as the Web pages viewed and the links clicked).

3. Billing Information

In order to purchase a subscription you must provide certain information which may include a credit card number, expiration date, billing zip code, and similar (“Billing Information”). Billing Information is collected and processed by BrainTree, a PCI compliant third party payment processor. We do not directly process or store any Billing Information. The collection, use and disclosure of Billing Information is subject to the third party’s privacy policy and not this Privacy Policy.

4. Cookies

When you visit the Site, we use “session cookies” (a piece of information stored on your computer temporarily and deleted from the user’s device when the browser is closed) and “persistent cookies” (which stay on your device until you delete them). Session cookies help us confirm your identity and are required in order to log into your account. Whereas persistent cookies assist you in using the site or Service (such as not having to reenter your username and password each time you use the Service) or aid in Site navigation.

If you wish to prevent cookies from being used as you navigate our Site, you can set your browser to refuse all cookies and/or indicate when a cookie is being sent. Users who disable their web browsers’ ability to accept cookies will be able to browse the Site, but may not be able to access or take full advantage of all of the features and services on the Site. We therefore recommend you do not block or disable these cookies.

5. Social Media

Our Site includes features from third party social media websites such as Facebook, Twitter, YouTube and LinkedIn that run on our Site. Please note our Site is not sponsored or endorsed by any of these social media sites, which are trademarked and owned by third parties and not by us. These features may collect your IP address, which page you are visiting on our Site, and may set a cookie to enable the feature to function properly. Social media features are either hosted by a third party or hosted directly on our Site. This Privacy Policy does not apply to these features. Your interactions with these features would be governed by the privacy policy and other policies of the companies providing them.

Information Sharing and Disclosure

1. Third Party Applications

We disclose the Personal Information of our users to third party vendors who help us operate the Site. These third parties may be based in locations outside the EU/EEA. These third parties are contractually obligated to maintain the confidentiality of your Personal Information consistent with the terms of this Policy and to comply with the applicable data protection laws.

2. Legal Requirements

We may disclose your personal information and other information if we believe in good faith that such action is necessary in order to comply with (i) a legal obligation, (ii) protect and defend the rights of Elegant Labs, (iii) act in urgent circumstances to protect the personal saftey of our users, or (iv) protect against legal liability.

3. Business Partners

Elegant Labs may partner with other companies to jointly offer products or services. You will be asked to specifically opt in to share your Personal Information with our business partners if you choose to purchase or specifically express interest in a jointly offered product or service. If you do not wish for your information to be shared in this manner, you may choose not to purchase or specifically express interest in a jointly offered product or service.

4. Acquisition

We may transfer your information to an entity or individual that acquires, buys, or merges with Elegant Labs, or our other business units. In the event of such, you will be notified via email prior to such disclosure, as well as the choices you have regarding your Personal Information in accordance with applicable law.

Choice and Consent

It is always your choice whether or not to provide us with Personal Information. If you do provide Personal Information to the Site, you are giving your express and unambiguous consent to the processing of your Personal Information as described in this Privacy Policy. If you choose not to provide the requested information you may not be able to access certain features on our Site or the Services. You may access, change, modify or delete your information, at any time, as described below.

We do not disclose your Personal Information to third parties for direct marketing purposes. You may also opt out in the event we use your Personal Information for a purpose that is materially different from the purpose(s) for which it was originally collected or subsequently authorized by you.

International Transfer of Data

Personal Information collected on the Site and through the Service may be processed and transferred from time to time to locations throughout the world and the Site my be viewed and hosted anywhere in the world. The Personal Information of users who are located outside the U.S. may be transferred outside of each eligible country to the U.S., where our servers are located and where it will be processed and stored on servers in the U.S. By providing Personal Information or accessing the Site or Services, you expressly and unambiguously agree to such transfer, processing, storage and disclosure in countries outside the EU and Switzerland.

Data Security

We have taken appropriate physical, technical, and organizational safeguards to protect Personal Information from theft, other loss, misuse, and any unauthorized access, copying, collection, use, disclosure, alteration, or destruction. We follow generally accepted standards to protect the Personal Information submitted to us, both during transmission and once we receive it.

We take all reasonable measure to ensure your personal data that we process is accurate and when necessary, up to date. From time to time we may ask you to confirm the accuracy of your Personal Information.

Data Retention 

We retain Personal Information as long as needed to provide the Services and accomplish our business purposes. We will retain and use Personal Information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Your Personal Information and Legal Rights

Children
